How are the cruise lines avoiding fines for the Jones Act during the Mexico travel advisory? There are many cruises from California and also the Gulf Coast that are stopping in American ports such as Catalina and Key West instead of leaving the country and going to Ensenada or the Yucatan. Has it been waived during this or are they absorbing the fines? |

I haven't seen anything one way or the other in any of the news sites I check every day. I suspect that they're either going to alternative ports (There's more then just Mexico out there), absorbing the fines, or it's been waivered in the interests of public health. There were some short cruises that were only going to American ports. One example is the usual 3-night Carnival cruise out of LA which would make a one stop in Ensenada. During the last month it was going to Avalon, California only. I realize that the advisory is over, but I am still curious how the industry handles this in times like this. I'm wondering if the U.S. Government actually relaxed it during this time or if Carnival went ahead and paid the fine. I had seen that some of the lines had turned short cruises into "cruises to nowhere" which apparently are exempt from the Jones Act. Another report I saw is that Royal Caribbean has changed it's 7-day Mexican Riviera to a "Pacific Coastal" cruise with stops up to coast all the way to Canada and back. |

For whatever it's worth, information on the Jones Act (Merchant Seaman Protection and Relief 46 USCS Appx § 688 (2002) Title 46. Appendix. Shipping Chapter 18.) can be found at http://www.shipguide.com/jones-act/ The text itself doesn't appear to deal with cabotage issues there might be an annex somewhere which does.
