The NORMANDIE sails under the command and control of the French line, and passengers are subject to the rules and regulations of that company and to the terms of the ticket for ocean carriage issued by that company.
All arrangements for, shore accommodation, transportation and sightseeing are made by Raymond-Whitcomb Inc. All arrangements for ocean transportation are made by the French Line, which company shall not be held responsible for any act, neglect, default or omission of any person or company whomsoever in respect to undertakings, events, matters or things whatsoever not immediately aboard the steamship or tenders used in embarking and disembuking passengers to or from the same. or 'the failure thereof. The usual passenger contract in use by the French Line. when issued, shall constitute the sole contract between the French Line and the purchaser of this Cruise and/or the passenger, and the Steamship Company abaft incur no obligation to passengers or others greater than that incurred by it to passengers traveling by said steamship upon such usual form of passenger contract.
Raymond-Whitcomb Inc. give notice that all tickets and coupons are issued by them, and rill arrangements for transportation or conveyance or for hotel accommodation are made by them, as agents only, upon the express condition that they shall not be liable for any injury, damage, loss, accident, delay or irregularity which may be occasioned either by reason of defect in any steamship, train, automobile, carriage or other conveyance or facility used in the carrying out of the Cruise or any Shore Excursion, or through the acts or defaults of any company or person engaged in conveying the passenger, or of any hotel proprietor or servant, or of. any other person engaged in carrying out the arrangements of the Cruise or any Shore Excursion, or otherwise in connection therewith.
Raymond-Whitcomb Inc. accept no responsibility for looses or additional expenses caused by any alterations in the itinerary of the Cruise due to any cause, or by delays or changes in any train or steamer services, sickness, weather, strikes, war, quarantine. or other causes, and all such losses or expenses shall be borne by the passenger.
Raymond-Whitcomb Inc. act as agent only, in arranging for the transportation of baggage. Such transportation is at. the passenger's own risk, and all baggage should be insured. Overcoats, coats, umbrellas, cameras, small handbags and traveling rugs remain at all times under the passenger's control.
The fares charged for the Cruise provide for accommodations only for the time stated elsewhere in this booklet. The right is reserved to withdraw the Cruise or any Shore Excursion offered in connection therewith without incurring any liability what-ever except for the refund of the whole or suitable portions of sums actually paid, and it is agreed that the commander of the NORMANDIE has the right from time to time to change the itinerary whenever condition in his opinion render it necessary or advisable, and that the French Line and/or Raymond-Whitcomb Inc. have the right, through their accredited representatives, to decline to accept or retain, at any time, any person as a member of the Cruise or of any of Its Shore Excursions.
Without limiting the general terms above, it as expressly provided. to conform to the terms of the agreement between Raymond-Whitcomb Inc. and the French line. that if the NORMANDIE is delayed or prevented from sailing, except from a cause not attributable to lack of due diligence on the part of the French Line or horn a cause of whatsoever nature beyond the French Line's control, Raymond-Whitcomb Inc. may cancel any contracts with the passengers without any liability whatever on the pert of Raymond-Whitcomb Inc. and/or the French Line to any passenger except the obligation to refund sums already actually paid, and further that Raymond-Whitcomb Inc. will not exercise this right of cancellation if any delay, whatever the cause, is of such nature as would permit of the NORMANDIE 'S sailing within one week of the scheduled date of departure.
In these General Conditions, and elsewhere in this booklet, the term "French Line" means the Compagnie Generale-Transatlantique. commonly known in America as the "French Line".
