1921 Storm Damage / Passengers Killed / Injured

In December 1921 the Olympic sailed threw a terrific storm with 120 mph winds that killed, injured, and also damaged the ship, smashing 30 windows, throwing furniture about, and soaking the cabins. If such a thing occurred today would any legal action take place against the captain or company?
