David Sarnoff The Farnsworth Invention

Just saw the new Broadway play "The Farnsworth Invention" by Aaron Sorkin about the competition between Sarnoff & Philo Farnsworth to build the first TV. In Sarnoff's scene where he gets the wire from the Carpathia- he names imaginary Titanic survivors- no name is similar to the early published lists. Is this a copywright issue or careless dramaturgy?

I'm thinking it's the latter. The Carpathia's list of Titanic's survivors is hardly copyrighted.
